Divine Party Rentals Rental Terms & Conditions
These Rental Terms & Conditions govern equipment and services provided by Divine Party Rentals to the customer identified on the accepted quotation, sales order, or invoice.
1. Rental Agreement and Documents
The rental agreement consists of the accepted quotation or invoice, these Terms & Conditions, any applicable fee schedule, and equipment-specific safety instructions. The accepted order identifies the rented equipment, quantities, event location, rental dates, delivery and collection arrangements, charges, and included services. Any exception or modification must be approved by Company in writing.
2. Reservations and Payments
A reservation is confirmed only when Company accepts the order, Renter accepts the rental agreement, and the required 50% reservation payment is received. The remaining balance must be paid at least seven calendar days before the scheduled event. Reservations made within seven calendar days of the event require full payment at booking. Bookings accepted within 72 hours require immediate payment to confirm.
3. Cancellations, Reductions, and Rescheduling
Cancellation, item-removal, and rescheduling requests must be sent to invoice@divinepartyrentals.com. More than seven calendar days before the event, the cancellation charge is 50% of canceled equipment and service charges. Seven calendar days or less before the event, the charge is 100%. Date changes require written approval and inventory availability.
4. Weather and Unsafe Conditions
Company may reasonably delay, refuse, modify, stop, or remove affected equipment when weather or site conditions create a safety risk. Tents are not storm shelters. When Company cancels affected equipment before delivery or setup because of unsafe weather, amounts paid for that equipment and associated services not performed become a raincheck credit, subject to the agreement’s stated conditions.
5. Delivery, Installation, and Site Access
Standard delivery includes ground-level drop-off within 50 feet of the delivery vehicle along a safe, unobstructed route. Renter must provide timely access and a clear, suitable, level installation area and disclose access restrictions. Renter must obtain property-owner permission and provide required venue access and parking passes.
6. Order Changes
Additions are subject to availability. Reductions and removals are treated as partial cancellations. Changes requested within seven calendar days of the event may require immediate payment and may be declined once equipment has entered preparation, loading, or routing.
7. Customer Supervision and Safe Operation
Rentals are customer-supervised after setup unless an attendant is expressly listed on the invoice. Renter must designate a responsible adult age 18 or older to receive applicable operating and emergency instructions and supervise use. Equipment must not be left available for unsupervised use.
8. Electrical and Service Requirements
Renter must provide the required circuits, power capacity, water supply, and approved connections at the installation location unless Company expressly agrees otherwise. Missing or unsafe utilities may prevent installation or operation.
9. Inspection, Defects, and Incidents
Renter or the designated adult must be available for delivery inspection and safety handoff. If equipment malfunctions or an incident occurs, Renter must stop affected use, protect people from further danger, notify Company promptly, and call emergency services first when appropriate.
10. Equipment Care, Loss, and Damage
Routine cleaning of reusable rental equipment is included unless otherwise stated. Renter must not alter, repair, sub-rent, relocate, or use prohibited materials on rental equipment. Lost, damaged, missing, or excessively soiled equipment may be addressed under the accepted agreement and fee schedule.
11. Optional Rental Protection
Optional Rental Protection may be offered at checkout. It is not insurance and does not relieve Renter of all responsibility. Coverage, exclusions, deductibles, limits, and qualifying damage are governed by the Rental Protection terms presented at checkout.
12. Cleaning and Linens
Renter must remove food, trash, and loose debris before pickup. Do not wash linens or use chemicals on equipment unless Company instructs you to do so. Burns, tears, missing items, and permanent stains may result in applicable charges.
13. Overnight Rentals and Pickup
Overnight use requires Company’s written approval. Renter must secure equipment against theft and unauthorized use and make equipment accessible at the agreed pickup time. Extensions require written approval.
14. Company Nonperformance
If Company cannot provide an item or service for reasons other than unsafe weather, customer default, or a customer-controlled site problem, Renter may accept a mutually agreed substitute or receive a refund for the unavailable item and unperformed associated services.
15. Responsibility for Claims
Renter is responsible for its own negligent or wrongful acts and failure to perform accepted supervision and other duties. Nothing in this agreement removes remedies required by applicable law.
16. Applicable Law and Agreement Administration
This agreement is governed by the law of the state or District where the equipment is delivered, subject to mandatory law and applicable choice-of-law rules. Changes require written agreement. Electronic signatures and electronic acceptance may be used as permitted by law.
17. Acceptance
By signing or electronically accepting, Renter confirms that Renter is at least 18, has authority to enter this agreement, has reviewed the accepted invoice and these terms, understands payment, cancellation, weather-credit, and supervision provisions, and will designate an adult to receive equipment-specific instructions before use.
